Requirements for Nulla Osta: Legal capacity to contract marriage

1. Birth certificate*

In case of lost birth record due to the destruction or missing LCR pages:

a) CERTIFICATE OF NON-AVAILABILITY OF BIRTH RECORD from the Local Civil Registrar: indicating the reason why there is no available birth record(*)

b) BAPTISIMAL CERTIFICATE

c) JOIN BIRTH AFFIDAVIT signed and executed by two disinterested persons notarized by a Notary Public.

2. CERTIFICATE OF NO RECORD OF REGISTERED MARRIAGE from the National Census and Statistic Office attesting to the single status *

3. AFFIDAVIT OF CONSENT/ADVISE signed and executed by parents, notarized by a Notary Public indicating their  consent or advice to the marriage, if below 25 years old.

4. COURT DECREE ON DIVORCE/ NULLIFICATION OF MARRIAGE, in case of marriage between a Filipino citizen and a foreign national and a divorce decree is validly obtained abroad by the alien spouse*

5. DEATH CERTIFICATE OF SPOUSE, if widowed*

6. MARRIAGE CONTRACT WITH DECEASED SPOUSE, if widowed*

7. PHOTOCOPY OF VALID PASSPORT

8. THREE (3) IDENTICAL PHOTOGRAPHS, size 4.50 cm x 3.50cm, colored or b/w and white-with plain, white background newly taken by a photo studio.

(*) STEPS FOR AUTHENTICATION

STEP 1 - Secure an authenticated true copy of the document with the registration No./LCR from the NATIONAL STATISTICS AND CENSUS OFFICE (NCSO), Civil Registry Division, Vibal Building, Times St. corner EDSA, West triangle, Quezon City.

STEP 2 – Bring the authenticated true copy of the document  issued by the National Statistics and Census office to the OFFICE OF THE PRESIDENT, Malacanang, Manila.

STEP 3- Bring the authenticated true copy of the document issued by the Office of the President Malacanang, manila to the DEPARTMENT OF FOREIGN AFFAIRS, 2330 Roxas Boulevard, Passay City.

If fiancé is a foreign citizen, please submit the following documents of the foreign citizen:

1. Certificato di stato libero from the comune

2. carta d’identitŕ or passport

3. Certified true copy of Court decree on Divirce

4. Death certificate of deceased spouse if widowed

5. marriage contract with deceased spouse, if widowed
